The Laken Riley Act: A Step Forward in Immigration Law Enforcement

On January 29, 2025, President Donald Trump signed into law the Laken Riley Act, marking an important step in the battle against illegal immigration and its associated criminal activities. Headlines that day were filled with reports of Attorney General Ken Paxton expressing his support for the newly signed law. Paxton, a staunch advocate for strict immigration laws, praised the Act as it would enable a greater role for attorneys general in enforcing immigration laws.

The Laken Riley Act is named after a tragic victim of a crime committed by an illegal alien, Laken Riley. In a press release, Paxton blamed the devastating consequences, such as the murder of Riley, on the open border policies of Joe Biden. He expressed his approval of President Trump’s efforts towards apprehending every violent, criminal illegal immigrant, stating, “The Laken Riley Act will help us accomplish that mission.”

The Act intensifies the fight against illegal immigration by expanding the list of criminal acts that trigger the mandatory detention of an illegal alien. Newly added crimes include burglary, theft, larceny, shoplifting and assault of a law enforcement officer, or any crime that results in death or serious bodily injury to another person. The Laken Riley Act also empowers state attorneys general to enforce all of these mandatory detention requirements—as well as the limits on granting parole to aliens.

If this provision in the Act had been in place during Biden’s Administration, Attorney General Paxton would have had another tool to enforce immigration laws and hold the Biden Administration accountable for their open border policies which Paxton views as dangerous and radical.

In his statement, Paxton reiterated his commitment to work with President Trump to reverse the alleged lawless open border policies of Joe Biden, and ensure that illegal aliens intending to harm citizens of the United States are prosecuted to the fullest extent of the law. The Laken Riley Act provides the legal framework to make this possible and is interpreted as an important win for those pushing for stricter immigration laws and better enforcement.

Following the announcement of the Act, Attorney General Paxton remained active in relevant legal spheres. He stopped an Austin business from operating an international human trafficking scheme, urged the Texas Legislature to fund the OAG’s law enforcement initiative to keep Texas safe, and hosted a Crime Victims Services Conference to facilitate assistance efforts for victims of violent crime and exploitation.

The signing of the Laken Riley Act is just one step in a series of ongoing efforts to strengthen immigration laws and their enforcement in the United States. It remains to be seen how these laws will evolve and adapt to the constantly changing immigration landscape, but the commitment of legal stalwarts like Attorney General Paxton signifies a determined effort to keep the country safe from the threat of illegal immigration and associated crime.
